A man who said he opened fire in a crowded Walmart parking lot out of self-defense was released from jail late Thursday night.
Local 6 spoke to Jose Martinez as he got out of jail to ask about new surveillance video that contradicts his account of what happened.
Orange City police said Martinez fired at least five bullets through the busy Walmart parking lot as he was trying to stop a shoplifter from driving away.
"The guy put me in danger and other people," Martinez originally told reporters during his arrest on Wednesday. "He tried to run me over."
However, police said his actions were not self-defense.
The security video shows the alleged shoplifter, Eddie Mckee, run out of the store and Martinez chasing, and even trying to open the door to the moving car.
Police said he only pulls the trigger after the car had driven away, and that the car put nobody in danger, but the gunfire did. Bullets shattered the trunk and back window, hit two other cars, and came dangerously close to the store manager.
"I'll have a statement later," is all Martinez would say when asked if he still stands by what he did.
Even a man who identified himself as Martinez's father told Local 6, he has not yet made up his mind.
"All I saw was what was on TV," said Martinez's father. When asked if he defends his son's actions, he replied, "I will talk to him. I haven't had a chance to talk to him. I'll to talk to him."
Martinez did have a concealed weapons permit.
