ST. PETERSBURG, Fla. -

Prosecutors say a St. Petersburg bartender won't face criminal charges after a patron was injured as he was throwing him out of the Suite Six Bar & Lounge.

The incident happened June 30 just before last call. The Tampa Bay Times reports 24-year-old Blake Ambrester tossed 39-year-old Jeremy Fisher of Miami out after an employee complained she felt uncomfortable and threatened. Fisher refused to leave and became "physically resistant." He passed out and fell face first as Ambrester hauled him outside.

Fisher had head and neck injuries that required surgery. Ambrester was arrested a few days later and charged with battery.

Prosecutors say they've determined the way Fisher fell was more his fault than the bartender's.

The bar still faces a civil suit.
