DELTONA, Fla. -

Neighbors of a man killed on Christmas Day want to know why the shooter has not been arrested.

69-year-old Bruce Fleming was working in his yard when a stray bullet struck and killed him.

"I feel a little shocked that there wasn't an arrest," his neighbor Jeff, who would only give his first name, told Local 6.

Jeff lives across the street and heard the shots coming from the field adjacent to Fleming’s property in a rural area in Volusia County on Christmas Day.

Deputies identified the shooter, but haven’t released the person’s name or charged them.

The Volusia County Sheriff’s Office says it is still an active investigation, and they are waiting on the Florida Department of Law Enforcement to complete forensic testing before they decide whether to pursue charges or not.

The sheriff’s office has said the shooting may have been an accident. Jeff said he believes it was negligence and says the shooter should be arrested.

A spokesperson from FDLE told Local 6 the forensic testing should be completed within the next five to ten days.
