Passenger detained for 'unflushed toilet'

A California man claims he was detained by federal agents after not flushing the toilet during a cross-country flight.

Salvatore Bevivino, 52, was greeted by uniformed officers after his Virgin America flight from Philadelphia to his hometown of San Francisco touched down on April 28, 2012, the New York Daily News reported.

Crew members had reported him for "using profanities and not listening to instructions from the flight," according to The Smoking Gun.

They also accused him of not flushing the toilet on board correctly.

Bevivino was eventually released without charges and is now suing Virgin America for $500,000.

In the lawsuit, he claims the incident had caused him embarrassment, humiliation, mortification, mental anguish and emotional distress, and damage to his professional reputation.

The litigation accuses Virgin America of violating Bevivino's civil rights through false imprisonment, discrimination and denial of equal rights, the Philadelphia Inquirer reported.
