Trial for Jacksonville child murder suspect delayed

Donald Smith appears in court as his trial is delayed.


The trial for Donald Smith, the man accused of abducting and killing 8-year-old Cherish Perrywinkle last year, has been delayed until Oct. 6, WJXT reports.

Smith's trial was set to start May 12. He's charged with kidnapping, sexual battery and murder.

Smith is accused of abducting the girl from a Northside Walmart after befriending her mother and offering to buy her and her family food and clothes, then killing her.

Investigators said Smith dumping Cherish's body near a church off of Broward Road.

Prosecutors are seeking the death penalty.

Smith was already a registered sex offender in Florida and had been released from jail only a month before Cherish was kidnapped and killed.
